Terms of Service

VIEWCY.COM INC.
TERMS OF SERVICE

Last updated: October 9, 2026

What changed in this version. These Terms now cover attendees, members and students as well as organizers; say plainly that the organizer is the seller and Viewcy collects payment on the organizer's behalf; set the rules for refunds (the organizer's policy governs), chargebacks, payouts, memberships and private lessons; narrow the license you give us to your content; add a copyright notice procedure; and set out how we change these Terms. Fees are no longer written into the Terms: they live on the Fees page and in your organizer settings.

1. Who these Terms are for

Viewcy.com Inc. ("Viewcy", "we", "us") runs www.viewcy.com, the Viewcy mobile apps, the Viewcy check-in app, the organizer tools, the public API, and the checkout and calendar widgets organizers embed on their own sites (together, the "Service"). These Terms are a binding agreement between you and Viewcy. By creating an account, buying a ticket, joining a membership, booking a lesson, or otherwise using the Service, you agree to them and to our Privacy Policy.

Two kinds of people use Viewcy, and these Terms speak to both:

  • Organizers: venues, schools, artists, teachers and anyone else who lists events, memberships or lessons on Viewcy (including their collaborators and staff). Part A applies to you.
  • Attendees: anyone who buys a ticket or RSVPs, joins a membership, books a lesson, watches a video, or otherwise takes part in something an organizer offers. Part B applies to you.

Parts C and D apply to everyone.

2. Our role

Viewcy is the technology provider. The organizer is the seller. When you buy a ticket, join a membership offered by an organizer or book a lesson, your contract for that event, membership or lesson is with the organizer, not with Viewcy (a Viewcy membership, sold by Viewcy itself, is described in B3). The organizer decides what is offered, at what price, with what rules, and is responsible for delivering it.

When an organizer uses Viewcy to take payment, the organizer appoints Viewcy and its payment processor, Stripe, as its limited payment collection agent. A payment you make through Viewcy counts as a payment made directly to the organizer, and the organizer must then deliver what you bought as if it had received the money itself. Viewcy does not hold ticket money as the organizer's bank; funds are paid out to the organizer's connected Stripe account.

We do not run, sponsor, supervise or guarantee any event, membership or lesson, and we are not party to disputes between organizers and attendees. We will help where we reasonably can.

3. Accounts and eligibility

You must be at least 13 to use the Service, at least 18 to organize, and at least 18, or have your parent or guardian's permission, to pay or to hold a membership. A parent or guardian who books a lesson or buys a ticket for a child does so in their own name and is responsible for the booking and for the child's use of it.

Keep your sign-in details to yourself and tell us straight away at support@viewcy.com if you think your account has been used without your permission. You are responsible for what happens under your account. Give us accurate information and keep it current. You may hold one personal account; an organization may have one organizer profile with as many collaborators as it needs.

Part A: Organizers

A1. Your listings

You are responsible for every event, membership, lesson, video and other offer you publish: that it is accurate, lawful, and delivered as described. You must hold every license, permit, insurance and right the offer needs (including performance and music rights), and you must comply with the law where the event takes place and where your attendees are. You must not list anything illegal, unsafe, misleading or infringing, and you must not use Viewcy for raffles, lotteries or gambling unless we have agreed to it in writing.

A2. Payments, fees and payouts

Payments are processed by Stripe. To be paid you must complete Stripe's onboarding for a connected account, and you agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. Payouts go to that account on Stripe's schedule for your country.

Our fees are shown on the Fees page, and the exact amounts for your account and currency are shown in your organizer settings and at the time of each sale. For each ticket you choose the fee the buyer pays on top of the ticket price, from none (you absorb our fee and Stripe's) to all of it or more; anything above our fee and Stripe's is paid to you with the ticket price. Unless we have agreed a different rate with you in writing, the published fees apply. We may change our fees with at least 30 days' notice by email or in the product; the change applies to sales made after it takes effect.

Our fees are earned when a sale completes and are not refunded when you refund a buyer, except where the law requires it. Where we reasonably believe there is a risk of fraud, chargebacks, refunds or a legal claim, we may ask Stripe to delay your payouts or hold a reserve, where Stripe allows it, and we will tell you when we do. You authorize us and Stripe to deduct refunds, chargebacks, dispute fees, our fees and any amounts you owe us from your payouts, and to invoice you for any shortfall, which is due within 14 days.

A3. Refunds, cancellations and chargebacks

You set your refund policy, must show it to buyers before they pay, and must honor the policy you set. Whether to refund beyond it, including when you cancel or move an event, is between you and your buyers, under your policy and any law that applies to your sales. Refunds are made through Viewcy to the original payment method; our fee on a refunded sale stays earned, as A2 says. You are responsible for every chargeback on your sales and for the dispute fee the card network or Stripe charges, whether or not you win the dispute.

A4. Taxes

You are responsible for determining, collecting, reporting and paying every tax that applies to what you sell, including sales tax, VAT, GST, amusement and admission taxes, and income tax. Viewcy does not calculate or remit taxes for you, and our fees do not include them. Where the law requires us to charge tax on our own fees, we will add it to our fee.

A5. Attendee data

When someone buys from you, we give you their name, email address, the answers to your checkout questions, their order details and, for lessons, any note they wrote to you. You are an independent controller of that data, and so is Viewcy for its own use of it as the Privacy Policy describes. You must use it only to run the event, membership or lesson they bought, to meet your legal duties, and for marketing only where you have the consent or other legal basis the law requires. You must keep it secure, honor deletion and access requests, and comply with the privacy laws that apply to you, including, where they apply, the GDPR, the UK GDPR, the California Consumer Privacy Act and the US CAN-SPAM Act and TCPA. You must not sell attendee data or use it to contact people about things they did not sign up for.

A6. Messaging tools

Viewcy lets you email your attendees and, for a private event, send invitation and access texts to phone numbers you or your approved guests enter. You are the sender. You must only message people who have agreed to hear from you about the thing they bought, honor every unsubscribe and STOP request, and include your identity in what you send. We may limit, delay or stop sending where we see complaints, bounces or abuse.

A7. Memberships and lessons you sell

If you sell memberships, you set the price, the billing interval and the benefits, and you must deliver those benefits for as long as a member is paid up. If you sell lessons, you set your availability, booking windows, cancellation notice and no-show rules in your lesson settings, and those rules are shown to students before they book. A student who cancels inside your notice period, or does not show up, may lose the lesson or the credit only if your settings say so.

A8. Collaborators

You may invite collaborators to help run your organizer profile. You are responsible for what they do on Viewcy, for giving them only the access they need, and for removing them when they leave.

Part B: Attendees, members and students

B1. Buying a ticket or RSVPing

Your purchase is a contract with the organizer, on the organizer's terms shown at checkout. Tickets are for personal use. The organizer may set rules on entry, age, transfers, resale and conduct, and may refuse entry if you break them. Unless the organizer has turned transfers off for a ticket, you can transfer it to someone else from your account; the new holder takes it on the same terms. A ticket admits one person to the occurrence it names. The organizer's door staff record each check-in, a checked-in ticket is not admitted again unless the organizer reverses that check-in, and the organizer's record of who was checked in is the one that counts.

B2. Refunds

Your purchase is a contract with the organizer, and refunds are the organizer's decision under the refund policy shown at checkout, including when an event is cancelled or moved. Ask the organizer first; if you cannot reach them, write to support@viewcy.com and we will help you reach them. When a refund is given, it goes back to the payment method you used, and the organizer's policy says whether any fee you paid on top of the ticket price is included. Nothing here limits refund rights you have under the law where you live.

B3. Memberships

There are two kinds of membership on Viewcy. A membership with an organizer is a recurring subscription to that organizer, sold by the organizer with Viewcy collecting payment as in section 2. It renews automatically at the end of each billing period, at the price in force for that membership, until you cancel. You can cancel at any time from your account; cancellation stops the next renewal and you keep your benefits until the end of the period you have paid for. We do not refund part of a period unless the organizer agrees or the law requires it. An organizer that changes the price must tell you before the first renewal at the new price, so that you can cancel first.

A Viewcy membership is a subscription to Viewcy itself: Viewcy is the seller, it supports the Universal Creator Income Fund, and it gives the benefits shown on the membership page when you join. It renews automatically at the price shown there until you cancel, and you keep its benefits until the end of the period you have paid for. Cancel it from your account, or, if you joined inside the Viewcy app through Apple or Google, through that store under its rules, which also govern its billing and refunds. We do not refund part of a period unless the law requires it, and we will tell you before any price change takes effect so that you can cancel first.

B4. Private lessons and credits

Lesson bookings follow the teacher's booking windows, cancellation notice and no-show rules, which are shown before you book. Lesson packs are credits that you spend on bookings; where the teacher sets an expiry date it is shown when you buy, and credits are not refundable for cash unless the teacher agrees or the law requires it.

B5. Donations and online events

Donations and pay-what-you-want tickets are set at the amount you choose and go to the organizer. They are not tax-deductible unless the organizer tells you otherwise.

B6. Text messages

We send text messages only for a sign-in code you request, and for an invitation or access notice for a private event, sent to a phone number that the organizer, or a guest the organizer has approved, entered for you. Message and data rates may apply. Reply STOP to any message to stop receiving texts from that sender. Our SMS Terms describe the program in full.

Part C: Content, conduct and intellectual property

C1. Your content

You keep ownership of everything you post on Viewcy: event listings, images, video, audio, text and answers ("Content"). So that we can run the Service, you grant Viewcy a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt (for example, to resize an image or transcode a video), display, distribute and perform your Content on the Service and in Viewcy's own promotion of the Service and of your listings, for as long as the Content is on Viewcy and for a reasonable time afterwards to remove it from backups and caches. Promotional uses made while the license was in force may continue. If people appear in your Content, you confirm you have their permission for these uses.

You confirm that you have the rights to post your Content, that it does not infringe anyone's rights or break the law, and that it is accurate. We may remove Content that breaks these Terms or the law, and we are not obliged to store Content indefinitely.

C2. Rules of conduct

You must not, and must not let anyone using your account:

  • break any law, or post anything unlawful, defamatory, pornographic, threatening, harassing or hateful;
  • infringe anyone's copyright, trademark, privacy, publicity or other rights;
  • impersonate anyone, give false information, or hold more than one personal account;
  • scrape, crawl or collect content, email addresses or other data from the Service by automated means, other than through the public API under its own terms;
  • reverse engineer, probe, overload, interfere with or attempt to get around the security of the Service;
  • upload malware, or use the Service to send spam or messages people did not agree to receive;
  • buy tickets for resale above face value where the organizer or the law forbids it, or use bots or multiple accounts to get around purchase limits.

C3. Copyright notices

We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act and similar laws. If you believe Content on Viewcy infringes your copyright, email support@viewcy.com with "Copyright notice" in the subject, and include: a link to the Content; a description of the work you say is infringed; your contact details; a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We may remove the Content, tell the person who posted it, and, if they send a counter-notice, restore it as the law provides. We close the accounts of repeat infringers.

C4. Viewcy's intellectual property

The Service, its software, design, logos and names belong to Viewcy or its licensors and are protected by copyright, trademark and other laws. We give you a limited, revocable, non-transferable license to use the Service under these Terms, and nothing else. Organizers may use the "Powered by Viewcy" and similar marks we provide, as we provide them, and we may identify ourselves on pages and emails that use the Service. If you send us feedback or ideas, we may use them without obligation to you.

C5. Third-party services

The Service works with third-party services, including Stripe for payments; Google, Apple and Facebook for sign-in; Google and Apple for app-store billing; Apple for Wallet passes; Google for calendar connections; and the video and messaging providers listed in our Privacy Policy. Their terms apply to your use of them, and we are not responsible for them. Content and links from third parties, including organizers, are theirs, not ours.

Part D: Legal terms for everyone

D1. Closing an account and termination

You can stop using Viewcy at any time and ask us to close your account, as described in our Privacy Policy. We may suspend or close an account, remove a listing, or ask Stripe to hold a payout if you break these Terms, if we must by law, if we see fraud or a serious risk to others, or if we discontinue the Service. Where we can, we will tell you why and give you a chance to put it right. When an organizer account closes, payouts for completed events continue through Stripe, less refunds, chargebacks and amounts owed to us, and we may ask Stripe to hold funds for up to 90 days after the last paid event for chargebacks. Ticket holders for events that will not take place should seek refunds from the organizer under its refund policy and applicable law, and we will help them reach the organizer. Sections 2, A2 to A5, A7, B3, C1, C4 and D1 to D7 survive termination.

D2. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, Viewcy disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, that defects will be corrected, or that any event, membership or lesson will take place or be as described. Organizers are responsible for what they offer.

D3. Limitation of liability

To the fullest extent the law allows, Viewcy and its officers, directors, employees, contractors and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to the Service or these Terms, however caused. Our total liability to you for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the fees Viewcy received from or for you in the 12 months before the claim and (b) one hundred US dollars ($100). These limits do not apply to liability that cannot be limited by law, including for fraud, gross negligence or willful misconduct, and nothing in these Terms limits rights you have as a consumer under the law where you live.

D4. Indemnity

You will defend, indemnify and hold harmless Viewcy and its officers, directors, employees and agents from any claim, loss, liability, cost and expense (including reasonable legal fees) arising out of your Content, your use of the Service, your breach of these Terms or the law, and, if you are an organizer, any claim by your attendees, staff, venue, performers or authorities about your events, memberships or lessons. We may take over the defense of any claim at our own expense, and you must not settle a claim that binds us without our written consent.

D5. Disputes and governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Before starting a claim, write to us at support@viewcy.com with a description of the problem and what you want, and give us 30 days to try to resolve it with you. If we cannot, any claim arising out of or relating to the Service or these Terms must be brought in the state or federal courts in New York, New York, and you and we agree to their exclusive jurisdiction and waive any objection to that venue. Either of us may instead bring a qualifying claim in small claims court. A claim must be filed within one year of when it arose, where the law allows that limit. If you are a consumer in the European Union or the United Kingdom, this clause does not take away the protection of the mandatory laws of your country or your right to bring a claim in your local courts.

D6. Changes to these Terms

We may change these Terms. When we do, we will update the date at the top and summarize the change. For a material change we will give organizers and account holders at least 14 days' notice by email or in the product before it takes effect, unless the change is needed to comply with the law or to address a security issue, in which case it takes effect when posted. Using the Service after a change takes effect means you accept it; if you do not, stop using the Service and close your account. Changes do not apply retroactively to a sale that was completed before they took effect.

D7. General

Entire agreement. These Terms, the Privacy Policy, the Fees page and any written agreement we have signed with you are the whole agreement between you and Viewcy about the Service and replace any earlier terms.

Severability. If a court finds part of these Terms unenforceable, that part is enforced to the extent the law allows and the rest stays in force.

No waiver. If we do not enforce a term, we may still enforce it later.

Assignment. We may assign these Terms as part of a merger, acquisition or sale of assets, and will tell you if we do. You may not assign them without our written consent.

No partnership. Nothing in these Terms makes you and Viewcy partners, joint venturers, employer and employee, or, except for the limited payment collection agency in section 2, agents of each other.

Notices. We will send notices to the email address on your account. Send notices to us at support@viewcy.com or to Viewcy.com Inc., 470 Ocean Avenue, Apt. LF6, Brooklyn, New York 11226-2884, United States.
